United States Warn China in Trade Fight

The United States government criticizes China to resolve its rapidly growing trade deficit.

Deputy US Trade Representative Karan Bhatia said that their rival country can receive penalizing trade measures from the US government if they do not open up their market to American companies and if they do not treat US firms fairly. However, Bhatia did not imply that the US government would limit China’s access to their market.

On the other hand, US Trade Representative Rob Portman has a different take on United States-China trade situation. Last week, he expressed that the US government will set up a task force that will monitor China’s compliance with global trade policies. These policies focuses on implementing of intellectual property rights, easing up local industries, and carrying out vows to open the market to US companies.

According to Karan Bhatia, China has very much profited from their access to the US market, yet China is not doing their share as they continue in not giving US companies a level playing field in their markets. Furthermore, as said by some critics, low-priced Chinese products has already flooded the United States, which resulted in financial struggles of US competitors and job insecurity in the industrial parts of the country. The Chinese government is also reported to keep the yuan currency weak in order to increase their exports.

Last year, the trade deficit went to a record low of $725bn (414bn) because oil prices rose and demand for imports of every kind increased.

In order to pacify US citizens who might lose their jobs because of the trade deficit, US legislators have proposed laws to lower trade relations with China. The US government also gave stern warnings to China to revalue its currency, and impose tariffs on Chinese products that is already flooding the country.

Analysts say that United States government has limited options and they could not afford to get even with China because these actions could backfire at them.

In response to United States’ stern warnings and criticisms, Chinese Foreign Ministry Spokesman Qin Gang expressed that the US plan to impose penalizing trade measures on them will not help ease their trade relations. He also said that such impositions will not also be favorable to the business interests of the United States.

At the moment, people are anticipating a resolution to this problem when Chinese President Hu Jintao visits Washington for talks with the US President in April.

The Legal Procedure Of Wage Garnishment

A legal procedure, in which some portion of a persons earning is required to be withheld by an employee for the payment of the debt, is called as wage garnishment. Most of these garnishments are made by court orders. There are some other legal procedures also which include IRS levies or state tax collection agency levies. They levy for the taxes, which are unpaid.

There are assignments in which the employees voluntarily agree that their employers will deposit a particular specified amount of their earnings to their creditor. But in the case of wage garnishment this voluntary assignment does not work.

Title III of Consumer Credit Protection Act says that person has his pay garnished for only one debt then the Act limits the amount of that employees earning that may be garnished. It even protects the employee from being fired also. If any garnished controversy in wage garnishment is arises, then the query solution part has to be taken directly to the court or the agency initiating that withholds the action. In the case of wage garnishment, Wage and the House Division, which administers the Title III Act cannot do anything.

The Garnishment law protects everyone from receiving their personal earnings like pensions, salaries, commissions, wages. bonus, etc. this law implies in all the 50 states. Wage garnishment is not prohibited if an employees earnings are garnished for or more debts.

There are some restrictions also on wage garnishment. The amount of pay subject to wage garnishment is based on the employees disposable earnings which includes federal state and local taxes and the share of employee in State unemployment Insurance and social security. These disposable earnings for wage garnishment under the CCPA many deductions are not made from the employees gross earnings such as voluntary wage assignments, union dues, health and life insurance, savings bonds purchased, payments made for payroll advances, contributions to charitable causes. Only the retirement plan contributions are deducted and that too only those which are required by the law.

For wage garnishment, the garnishment law sets the maximum amount that can be garnished from a person in a particular pay period. During the fixing of the amount, the law does not consider the member of garnishment orders received by the employer. In case of ordinary wage garnishment, which does not include bankruptcy etc., the amount of garnishment in a week may not exceed the lesser of the two figures. The garnishment amount maybe 25% of the disposable earning of the employee or the amount by which his disposable earnings are greater than 30 times the federal minimum wages. Of the pay period is weekly and the disposable earnings are lesser than the amount calculated through the federal minimum wage, then the garnishment cannot be done. A maximum of 25% can be garnished. The law for wage garnishment specifies that the restriction on garnishment does not apply to certain cases where the bankruptcy court order is issued or there are outstanding debts for the federal or state taxes.

Wage garnishment is the last option that an employer goes for. When all the other options for settling the due debts exhaust, then the employer opts for wage garnishment. Most of the wage garnishment requires a court order and even in that they are required to notify the worker 20 days before the garnishment goes into the effect.

If someone ignores the IRS, then wages are the first place that goes in for garnishment. It is not only the IRS but also the state government; private creditors or even an ex-spouse seeking alimony can go in for garnishment. The government creditors can garnish more than the paychecks. But the Title III of the Credit Consumer Protection Act limits the amount of wage garnishment from the workers paycheck. This facility leaves an employee with some income and at the same time creditor also get paid up regularly also prevents the creditor to speed up the recovery procedure.

As far as shapes and sizes go, there are many choices for you to consider. In general narrow kayaks with a rounded bottom will paddle faster and maneuver better wider and flatter kayaks will be more stable.

There are many materials to choose from for your kayak such as fiberglass, Kevlar, molded plastic, high impact plastic, and wood. For most people the molded plastic kayak will be the choice due to affordability and durability. These kayaks can take a beating and you can drag them over rough surfaces without damage. If you are a competitive kayaker you may want to go with a high impact plastic or Kevlar kayak.

Keep in mind the lighter kayaks made of Kevlar and fiberglass are more expensive to buy and more expensive to repair.

The worst of nature’s fury often brings out the best in people’s generosity toward those affected by disasters. For example, according to national headquarters of the American Red Cross, the organization received more than $2.12 billion from September to December 2005 to help victims of Hurricane Katrina in the south-central United States, with much of the money contributed through local American Red Cross chapters around the country.

What many people may not realize is that 100 percent of those dedicated donations went straight to the national Red Cross organization, creating some unintended fund-raising challenges for local chapters in their ongoing mission to serve the needs of people closer to home.

“Americans were very generous in giving to major national and international relief campaigns throughout the past year,” said Rick Hankins, director of administrative services and information technology for the Greater Cleveland Chapter of the American Red Cross.

“At the same time, events like Hurricane Katrina lead to what we call ‘donor fatigue’; people feel like they’ve already given all they can,” he said. “Meanwhile, there are still between one to three house fires in the greater Cleveland area each night, and we still depend heavily on local donations in order to help those families.”

When local donations dip below expected levels, charitable organizations such as local chapters of the Red Cross must quickly adjust their budgets and reduce expenses wherever possible. One way Hankins and his fellow managers have succeeded at this is through adopting new financial management technology to help them create more accurate budgets with less administrative overhead.

“We’ve switched from compiling budget spreadsheets by hand, which used to take days or weeks, to a Web-based budgeting application called Microsoft Forecaster that automates the entire process,” he said. “By managing our resources more effectively, we can put a bigger slice of every dollar toward helping people in need.”

Other ways the Cleveland-area Red Cross and chapters elsewhere have streamlined their operations include delivering more volunteer training classes online instead of in a classroom, and using the Web and e-mail to reach a larger pool of potential donors at a lower cost compared with regular mail.

“Technology has made a big difference in helping us work smarter,” Hankins said, “so our donors can know that their gifts truly have a positive impact in this community.”

Ask a boy what he wants to be when he grows up, and you’re unlikely to hear the response of “circus ringmaster.” And even if a youngster is intent on stepping into the center ring, most would not know how to get started on such a career path.

That path can be rather circuitous, as it was for Tyron Stucks McFarlan Jr., who grew up a “military brat” and enlisted in the Army National Guard at age 16. He completed advanced training while attending college, and graduated from the University of South Carolina with a degree in criminal justice. But, as McFarlan puts it, “Whatever is truly inside you is going to come out-sooner or later,” and for him that “whatever” was music; in high school he’d discovered a talent for singing and performing.

After college, McFarlan ventured into musical theater, modeling and commercial work. But it was his unique combination of talent, work ethic and physical presence that made him ideal for his biggest role: Ringmaster for The Greatest Show on Earth.

McFarlan describes his good fortune to be selected as Ringmaster as an occasion to “celebrate life” and looks forward to sharing his excitement with his daughter Nymah, who will visit him on the road throughout the show’s tour.

A Look At How Boat Lifts Work And The Different Types

Boat lifts are used to lift the boat and store the boat above the water surface. Boat lifts are generally of two types. They are i) Hydro hoist model and ii) the Air-Dock model. Boat lifts are manufactured keeping in mind the different sizes of the boats.

Boat lifts work on the principle of lifts and hoists. In Hydro hoist type model there are float tanks that have a drain fitting at the bottom which is always open to the water. The boats are lifted with the help of hoists that are driven by heavy motors. The Hydro-Hoist boat lifts are of several types such as Boat Floater, Econo Lift and others. In the case of Air Dock the pressure of air is required to uplift the boat to a certain height above the water surface. With Air Dock type boat lifts there is a water tank which is filled and evacuated with the air pressure. Here the air is pumped in from the atmosphere to force the water out of the water tanks thus lifting the hoist. To lower down the hoists, one should vent the air pressure to allow water to fill the again tank.

Generally a motor with a blower is attached which is about the size of a vacuum cleaner motor. These motors blow the air out of the float tanks. Each tank has a hole at opposite ends, where the hose is attached. These holes are about 4 inches in diameter. An electric switch is used to turn on the blower and a valve. To raise the boat lift the valve is opened and the blower motor turned on. It can be left on until air bubbles are out of the 4 inch holes, this is the maximum lift that can be obtained. Once the boat is lifted to the desired height the valve is manually closed and all the air is retained in the tanks. When the boat is to be launched the valve is opened and the captured air from the tank escapes past the blower and the lift settles into the lake.

Different new technologies are adopted regularly to enhance the working principles of boat lifts. These new technologies are a floating drive-on dry lifting system which makes existing technology obsolete. Fully portable, changeable and modular boat lifts will work in shallow water or deep water, fresh, tides or salt water, currents and even waves. These boat lifts have the power to lift boats of different sizes, from small boats to large watercrafts. What Kind Of Capital Is Appropriate For Your Business?

There are two kinds of capital: debt and equity. Both kinds are typically used by a company during its lifetime. Lenders have different objectives than investors and therefore look at different factors about a company when deciding whether or not to invest or make a loan.

Debt
Debt is money borrowed, which must be repaid at a set time period and generates income for the lender over that time period. Lending sources include not only banks, but also leasing companies, factoring companies and even individuals.

Lending sources look primarily at two factors: how risky the loan is; and whether the company can generate sufficient cash to pay the interest and repay the principal. The growth potential of the company is secondary; the primary considerations are the track record and asset base of the company. Usually the debt must be secured against the assets of the company and very commonly must also be secured against the assets of the owner of the company, also called a personal
guarantee.

Assets of the company are not usually given full book value in securing a loan. In other words, if your inventory has a book value of $50,000 (or it cost you $50,000 to produce that inventory) a lending source will only give you 50% to 75% of that value. The reason being is that the lending source is not in your business and would have to quickly liquidate the inventory, rather than selling it at market prices.

Accounts receivable, or money that is owed to you from customers who have previously purchased your product but not paid for it yet, are also discounted. Using the same example, $50,000 worth of accounts receivable may only be worth 60% to 70% of that value to the lending source. Customers may not pay the full amount owed, or feel they have to pay for the product at all, if an outside lending source is demanding payment. And so onwith equipment, land, buildings, furniture, fixtures and what ever other assets the company has, the same general rule applies.

The lender often requests that the personal assets of the owner of the company are pledged as a contingency and as a gesture of faith by the owner. Obviously, if the owner of the company does not believe in his/her own company’s ability to repay the loan, why should the lending source?

Equity
Equity capital is money given for a share of ownership of the company. Equity can be provided by individual investors, sometimes known as “angels”, venture capital companies, joint venture partners, and the sweat equity and capital contribution of the founders of the company. Equity providers are more interested in the growth potential of the company. Their objective is to invest an amount now and reap the rewards of a 5 to 1, or even 10 to 1, payoff in three to five years. In other words $100,000 now will be worth $1,000,000 in three years if invested in the right company.

Since the objectives of investors are different from lenders, the factors they evaluate in determining whether to invest are different from lending sources. Investors like to put money in companies that have the potential for rapid growth. Growth potential is based on the quality of management of the company, product brand strength, barriers of entry to competitors and size of the market for the product.

So Debt Or Equity Capital?
The answer is dependent on the answers to several questions: Why does the company require additional capital? What stage is the company at? What is the financial condition of the company? How much capital is required? What constraints will the financing source put on the day-to-day operations of the company? And finally, what impact will the financing source have on the ownership of the company?

Why Does The Company Require Additional Capital?
The reasons funds are required, or how they will be put to use, may lend themselves more to debt than to equity or vice versa. Debt is often a source of funds for the day-to-day operations of the company or to refinance a current loan. Expansion capital can be debt or equity. Start up funds most often come from equity sources. A turnaround situation, refinancing a delinquent loan, covering a deficit in revenues, could be either, but in these cases the financing will come with a high price.

What Stage Is The Company At?
Companies grow through several different stages: seed, start-up, first stage, and second stage. The stage of the company can be an indicator of the risk involved. While neither debt nor equity would be prohibited at any stage, the older and more established the company is, usually the less risky it is.

Seed Stage–the idea for a product or company is in the mind of the founder, but there is still substantial research and development necessary to determine whether the idea is viable.

Start-up–the company has a business plan, a defined product, and basic structure, but little or no revenues are being generated. The product may still be just a prototype.

First Stage–the product is either ready for market, or is generating some revenues. The structure of the company is in place.

Second Stage–full scale production. The company’s product has been selling and accepted by the marketplace. The company is ready for a major national introduction of the product or introduction of a second product.

Established–the company has been operating successfully for at least three years.

Turnaround– the company has been operating for a number of years but is underperforming. A hard turnaround refers to a company that is not only underperforming, but has been in a cash deficit position with little hope of returning to a positive position without major restructuring.

What Is The Financial Condition Of The Company?
In certain situations the company’s financial condition will suggest one kind of capital over the other. If the company needs all its cash to fund its growth, then a loan is not feasible, because the company could not afford interest and principal payments. If the company just needs a line of credit to fund a cyclical increase in orders, then it doesn’t make sense to bring in an equity investor.

A lender looks at the asset base to secure a loan, and the cash that has been generated to pay the interest. They also look at what other debt or liabilities the company has and very often the debts and liabilities of the owner(s). The old adage that it’s easiest to get a loan when you don’t need one is close to the truth. A strong balance sheet, top heavy on cash, and light on the side of liabilities is easier to finance.

Investors look at how healthy the company is by reviewing trends in the operating statements and the balance sheet. A company that has demonstrated a positive trend in the past is looked upon favorably. However, the future outlook for the company’s product and market is just as important to an investor as the past performance. A company with a somewhat shaky past in a currently booming industry is probably preferable to an equity investor than a great performance in the past in an industry that’s on the downslide.

But what if your company is a start-up and doesn’t have much, if any, history? Then other factors will be reviewed such as:

How much money the owners contributed to the company.

How strong is the management team.

How dedicated to success is the management team.

What other proprietary assets might be available such as patents, trademarks, goodwill, etc.

What barriers to entry to the marketplace are there?

While both debt and equity come at a price, the company must generate enough cash to repay the principal of the loan and the ongoing interest expense. Equity does not have to be repaid according to a fixed schedule. Equity investors are seeking long-term returns.

How Much Capital Is Required?
A small amount of capital required for a short time is not often an attractive situation to either traditional debt or equity sources. Lenders are not interested in loans that cost them as much in processing as in the income that can be generated. Investors feel that the due diligence required to fund a small amount of capital is nearly the same as that to fund a much larger amount.

On the other hand a very large amount of capital may only be obtainable if broken into stages that are funded based on achieving performance levels. For example: you have an idea for a diagnostic test that would be a medical breakthrough and revolutionize the treatment of all disease as we now know it. But you need $3.5 million to get the product ready to market. The initial funding may be as little as $50,000 to perform a literature and patent search to see if anyone else is working on the same idea and to determine the size of the market demand for the product. If the search shows that no one else is working on the idea, and the market is every doctor’s office worldwide, the second stage of $500,000 could be available to acquire lab equipment, hire lab technicians for six months, and hire consultants to develop a business and marketing plan. If the lab technicians develop a prototype test apparatus by the end of the six months, then $1,000,000 more could be available to develop a working prototype and patent it. When the working prototype is patented then $750,000 would be available to obtain FDA approval and independent tests.

What Constraints Will The Financing Source Put On The Day-To-Day Operations Of The Company?

You must consider how the financing source may limit the company’s operations. Loan covenants often restrict what the company can do with excess cash. They can also put limits on how much the company can spend, and on what type of expenditures, as well as demanding that the company maintain certain balances in their accounts, collect their receivable within certain limits, even determine the credit policies that the company extends to its customers. The company may not be able to take advantage of some opportunities because of these restrictions.

Equity investors can demand the same restrictions and in addition require that they have veto power in certain instances, or expenditure approval, even if they are in a minority ownership position.

What Impact Will The Financing Have On The Ownership Position?

The last issue and probably the most important one is, how will the owners react to having their ownership and management control diluted. An investor can often contribute experience and management expertise, as well as money, and has a vested interest in the success of your company. A lending source has no impact on the company (other than any loan covenants discussed above); its primary objective is to be repaid.

So Debt Or Equity? The choice is yours.

Picture your anger as a ball of fire next time when you are angry. The angrier you are, the bigger is the ball of fire. It can be as big as football or even the size of a mountain. Picture the ball of fire as big as your anger.

Notice the distance of the ball of fire from you. If it is too closer to you, put it away at a safer distance. Now, inspect the ball of fire carefully. Do you see the flames dancing around it? What is the color of the flame? Do you feel the heat of your anger? Does it make you sweat?

Anger makes us feel helpless over a situation. You feel helpless because all your power becomes centered around your anger. You feel it like a fiery lump, burning you head and heart. The idea is to picture this lump, and take back the power that it has taken from you.

Command the ball of fire to return back all the power it has taken from you. If you get no response, then demand from it. You might see a ball of pure gold smaller than the ball of fire emerge from the flames. Command it to go to either your head or your heart.

Do you feel the power in your heart? Do you feel the power return back to your head? Good! Sometimes, just separating the power from your anger makes the flames of anger die.

But, if there is any flame left in the ball of fire, roll it out mentally to a large reservoir of water. It may take a lake. Or it might even be an ocean.

Now, push the angry ball of fire into the water. Do you hear the hiss of the ball of fire when it meets water? See the white cloud of steam that arises. Slowly, the hissing sound subsides. The steam disappears. The angry ball of fire disappears completely. You have drowned your anger. And you have done it without harming yourself or others.

On the other hand, you have taken the power away from your anger and kept it with you. You are now POWERFUL.

In fact you are VERY VERY POWERFUL. Use your Power to your advantage.

Website content, as articles, has taken center stage as web publishers scramble to differentiate their online offers. As both the quantity and quality of articles have accelerated, so too have online directories. These directories often resemble mere lists, but they can be powerful content additions that serve to deepen the value of the overall selling proposition by helping users in locating critical, related resources that for the visitor is otherwise much too time consuming.

On today’s websites, it is not uncommon to find online databases designed to provide the data-hungry website visitor with more comprehensive database management functions which are far superior to list-style directories. At a minimum, we find web-driven data pages that include search and display functions which facilitate quick and easy manipulation of back-end SQL databases. Many sites also include options to add, edit, delete, print, and even download data directly from the database to the desktop, all enabled with multiple levels of login/password security. While this is not revolutionary, the technical expertise required to build database-driven web pages has been the domain of more sophisticated online publishers who not only owned the back end database outright, but possessed the required expertise to build and maintain such access for their loyal constituents.

But that has all changed. A flurry of new, low-cost desktop tools have entered the scene, leveling the playing field for the budget-strapped internet marketer who, until recently, was limited to throwing in a basic “telephone book” style directory in an attempt to bolster his value proposition.

Three such tool categories warrant a closer look:

Web data extraction tools costing less than $400 enable web content, as “repeating data”, to be easily extracted to MS Excel, MS Access, or virtually any SQL database in high volume. This data serves to build, or at least augment the publisher’s's new online database. (Ideally, one should first obtain permission from the website owner before scraping large volumes of data).

The next challenge is to manipulate the collected data now resident in multiple files, and often in disparate data formats. Though list processing applications have long been available, lower cost tools now offer powerful merge/purge capabilities without the need to import and export files in the process. Some simple routines and the data is ready to upload to the database on the host web server.

Finally, the publisher builds the web pages which access the database. Perhaps most exciting is the arrival of a wide variety of desktop code generators, many which are open source, that allow a non-programmer to build customized web pages that rival the database search, display, add, edit,delete and download capabilities previously reserved for the more technical publisher. No longer is the web publisher required to know a single SQL command to accomplish this feat. Amazingly, most of these tools generate pure PHP or PERL code. All that remains is to upload the generated code to the host database and the project is complete. The website now houses a “living, breathing” database, to the extent that the publisher desires to maintain fresh data.

One of the more common, and simple applications of database-driven web pages is to build versatile Frequently Asked Questions (FAQ) pages. Questions and answers can be queried by category (e.g. pricing, product) or keyword (e.g. sporting goods), while enriching the users support experience.

How can such newfound capabilities be monetized? The possibilities are plenty. Limited datasets can be made freely searchable and viewable for casual visitors, though it’s usually wise to request that the user register even if membership is free. The idea is to prime the pump, getting casual users to thirst for more comprehensive database access. Extended and full database access can be reserved only for paid members.

Never has a publisher had such power to build data-rich content that can serve to immediately strengthen his unique selling sales proposition. In the old paradigm, he who owned the data held all the power. Today, data is everywhere for the internet entrepreneur. By applying the latest database tools, any website publisher can now cement the most loyal of customer relationships by ensuring that his customer has a reason to keep coming back.

Web visitors have a difficult enough time sorting out the perceived sameness of online offerings. For the content builder, there are few better methods to establish and lock in immediate credibility with customers than to implement an easily accessible database that underscores the site’s overall content theme.
